Q: From: A. A. - from Iraq, he says: If a man has performed wudu' or is in a state of wudu', and he touches his mother or his sister or the like, does his wudu' become invalid?

A: The correct view is that touching a woman does not invalidate wudu', whether she is his wife or someone else. This is the correct view, and there is disagreement among the scholars. The scholars have three opinions on this matter:
The first is that touching a woman invalidates wudu' in all cases.
The second is that it does not invalidate it in all cases.
The third is to distinguish: if it is done with desire and pleasure, it invalidates wudu'; otherwise, it does not.
The stronger of the three opinions is that it does not invalidate wudu' in all cases. This is based on what is established from him (peace and blessings be upon him) that he kissed some of his wives and then prayed without performing wudu' (peace and blessings be upon him). It is also because the original state is the purity of the ritual state, so it is not invalidated except by clear evidence. Furthermore, people are tested with this matter in their homes, so if touching a woman invalidated wudu', the Prophet (peace and blessings be upon him) would have made it clear and would not have overlooked it, because he (peace and blessings be upon him) conveyed the clear message.
As for His saying (Glorified and Exalted is He) in Surat al-Nisa and Surat al-Ma'idah:
or you have contacted womenأَوْ لامَسْتُمُ النِّسَاءَ
[Al-Ma'idah: 6], the intended meaning is sexual intercourse, as stated by Ibn Abbas and many of the scholars.
The words "touching," "contact," and "touching" all have the same meaning, and in the most correct of the scholars' opinions, they all refer to sexual intercourse. However, if pre-seminal fluid comes out of a person during the touching, his wudu' is invalidated, and he must wash his private parts and the area around them, and then perform wudu' for prayer and the like.
