This is opening a door of evil, and this does not stand. Second, they said that this was before the prohibition of swearing by fathers, and that it was common and widespread at first, and people were accustomed to it, so the prohibition of it was delayed, just as the prohibition of alcohol was delayed, for it was not forbidden until the sixth year of the Hijrah. Likewise, the hijab for women was not obligatory until the sixth year of the Hijrah, because it is difficult for the soul to leave what is customary at first. So they said that the Shari'ah left them on this matter because it was customary for them. When faith became settled in their hearts, He prohibited it. And the oath of the Messenger (peace and blessings be upon him) by his father was before the prohibition. And at that time, we say that it was abrogated. But one of the conditions of abrogation is knowledge of the timing, and mere reasoning is not a ruling on delay or precedence. This is not sufficient; we must know the delay. And at that time, the saying of abrogation is also weak. Good.
Third, they said that this is something that slips off the tongue without intention, so it is from the idle oaths. And Allah the Exalted said:
Allah does not impose blame upon you for what is unintentional in your oaths لا يؤاخذكم الله باللغو في أيمانكم
