Question:

Answer:
He has no need to do so. It is a known principle in Islamic law: as long as no fitnah (trial, discord or temptation) occurs. If he has strength, or if they know that if he asks for the guest's right they will give it to him, or if he has the power to take the guest's right without fitnah and without a greater evil.
However, if taking the guest's right leads to something worse, it is known in the legal principle: leave that which leads to evil.
Q: What if he took it from him without his knowledge?
The Shaykh: It does no harm, just as a slave takes his maintenance and a wife takes her maintenance without their knowledge. He should do his best in this, seek out what is obligatory, and take it if it does not lead to a greater evil.
Q: Does he take it from the lowest of the people or from their leader?
The Shaykh: From the one who stayed with him, the group with whom he stayed.
