The Ruling on the Water from Which the One Performing Ablution Draws

Machine translationRead the Arabic original
Question:
The second translation: "The Chapter on Refuting Those Who Consider the Water from Which the One Performing Ablution Draws, After Washing His Face, to Be Used Water"?

Answer:
This is an argument against the author.
Q: Does this contradict what he said earlier?
A: And this is an argument against him; because putting one’s hand into the vessel does not make the water used water, and the Prophet (peace and blessings be upon him) used to put his hands in first for rinsing the mouth and sniffing water into the nose, then he put them in to wash his face, then he put them in to wash his hands, and so on.
Q: How do you reconcile this with that?
A: The reconciliation is that the water remains on the limbs of ablution, so it retains the ruling of being purifying.
Q: Then what if it separates?
A: If it separates, it becomes pure but not purifying, and this is evidence for the well-known position among the Hanbalis... pure and purifying and impure, which is the position of the Shafi'is and a group of scholars. The correct view is that there are two types: purifying and impure. What is called "pure" is actually purifying. The one that is only pure is the opposite category: such as rose water, pomegranate water, grape water. These are called only pure water; because they are mixed, restricted waters, not absolute water. As for the absolute water about which Allah said:
and find no waterفَلَمْ تَجِدُوا مَاءً
[Al-Nisa: 43], its ruling is purity. This is the original state, unless it is changed by impurity; then it becomes impure by consensus.
Q: Is the water from which the one performing ablution draws purifying?
A: It is pure, yes. The purifying quality remains in it as long as it is applied to the limbs. This is why it removes filth. The first wash may have some filth in it, then the second wash removes the remaining filth, then the third wash completes it. Likewise, if there is impurity on the limb, the first wash removes it or lightens it, then the second wash lightens or removes it, then the third wash until the impurity is gone.
