The Description of Lawful Marriage

Machine translationRead the Arabic original
Question:
Finally, you ask Your Eminence about the correct method of marriage so that it is in accordance with the Islamic way?

Answer:
Lawful marriage is when a man proposes to a suitable, religious girl, and then the contract is concluded for her through her guardian (wali), who is the closest of her residuary heirs ('asabah). The closest is the father, then the son, then the son's son, then the brother if the father and grandfather are absent and there are no sons, and so on.
The point is that he marries her through her guardian, who is the closest of her residuary heirs, and this is done in the presence of two just witnesses, provided she is free of any impediment. She must not be in a waiting period ('iddah), nor be a forbidden relative, nor be a disbeliever. However, chaste women from the People of the Book (Ahl al-Kitab) among the Jews and Christians are permissible for a Muslim to marry, provided they are chaste and modest. Yet, leaving them alone is preferable, and striving for a Muslim woman is even more preferable.
This lawful marriage is to be with a woman who is good in her religion and suitable for him, and her guardian (wali) takes charge of marrying her. He is her father, or her grandfather. If they are absent, it is her son and her son's son. If they are absent, it is the full brother, then the brother on the father's side, and so on with the rest of the residuary heirs according to inheritance, from the closest to the closest.
And this is to be done with two just witnesses, with her consent, not by coercion or force, but with her consent, and in the presence of two just witnesses, along with the customary mahr (bridal gift), yes, the one that the woman is satisfied with, yes.

The presenter : May Allah bless you.
