Question:
A message from Umm 'Ala in Bahrain says: My mother passed away many years ago, and she left an estate consisting of a small amount of money and gold. Her estate was not divided until this year, through the court, due to a dispute among the brothers and the court as well. I do not know if my mother used to pay zakah on this money, knowing that she had gathered it from all her children, and she intended to use it to buy a house to live in instead of the rented house. However, the divine decree and destiny of Allah are above everything. My question is: After we receive the estate from the court, is it obligatory for us to pay zakah, or how do you guide us? May Allah reward you with good.

Answer:
You do not have to pay zakah, unless she bequeathed that zakah be paid on her behalf for one year or two years. As long as you do not know, nothing is required of you. Yes. Praise be to Allah, the original presumption is that she paid it, and praise be to Allah.
