A listener from Yemen, Ali Abbas Fadel, sent a message asking: What is the ruling on a man who kisses his wife during the day in Ramadan? Does it invalidate his fast or harm it? And does he have to pay an expiation or not? Please inform us. May Allah reward you with good.
Answer: If a man kisses his wife while fasting, his fast is valid. Likewise, if he touches her or sleeps with her, none of this harms his fast. This is based on what is established from Aisha (may Allah be pleased with her), who said:
Allah's Messenger (ﷺ) used to kiss (his wives) while fasting and embraced (them) while fastingكان النبي ﷺ يقبل وهو صائم ويباشر وهو صائم
Sahih Muslim 1106d
And 'Umar asked him about that, saying: He kissed his wife. He said:
I felt a desire one day and kissed my wife. He said: What do you think if you had rinsed your mouth? He said: ...... He said: It is like that.هششت يوماً فقبلت امرأتي، قال: أرأيت لو تمضمضت؟ قال: ...... قال: هكذا
. Just as rinsing the mouth does not harm the fast, so too does kissing, provided that nothing comes out of him. However, if semen comes out of him, the fast is invalidated. But if nothing comes out, and he kissed her and touched her, but nothing came out, his fast is valid. Even if pre-seminal fluid comes out, it does not harm him, according to the correct opinion. Pre-seminal fluid does not invalidate the fast. It is the sticky fluid that comes out after desire, at the tip of the penis. This does not invalidate the fast. And if he fears, because of the quickness of his desire, he should refrain from kissing. If he fears that semen will come out because of his quick desire, he should refrain from that.
Abu Dawud (may Allah have mercy on him) narrated:
That a person sought permission from the Prophet (peace and blessings be upon him) to kiss, so he gave him permission. And another person sought permission, so he did not give him permission. The one he gave permission to was an old man, and the one he did not give permission to was a young man.أن النبي ﷺ استأذنه إنسان في التقبيل فأذن له، واستأذنه آخر فلم يأذن له، فإذا الذي أذن له شيخ كبير، والذي لم يؤذن له شاب
Some of the scholars of knowledge said: The meaning of that is that a young man may not be able to control himself, and his desire may overtake him, unlike an old man. There is a concern regarding its chain of narration.
The conclusion and summary is: If he fears, he should not kiss; he should refrain from kissing. But if he does not fear, meaning he knows himself and that there is no danger in kissing, then there is nothing wrong with it and no blame on him. Yes.
