Exhortation to Justice Between Wives
Machine translationRead the Arabic original
Question:
He says: We ask for a guiding word from your Eminence for men who have married more than one woman, so that they observe their rights and be just among them; this is because some women complain of injustice and lack of fairness. Is it the right of the woman to demand a separate house for herself and her children?
Answer:
It is obligatory for the husband to be just; it is obligatory for the husband to be just between two, three, or four wives, and it is forbidden for him to commit injustice or oppression. The Prophet (peace and blessings be upon him) said:Sunan Abi Dawud 2133Sahih (Al-Albani) So Allah, Mighty and Majestic, has made justice obligatory upon the husband regarding the division of time and financial maintenance.
As for what he cannot control, such as love, and what follows love, such as sexual intercourse and the like, this is not within his power, and he cannot control it. However, he must be just in dividing his time among them and in providing financial maintenance. Each one is given her needs according to his ability, and he must not be unjust in that.
As for his making a separate house for her; this is subject to detail: If she is with her family in a suitable place, that is sufficient. Even if she is with her family, it is not necessary for her to have a separate house. He may place her with her parents, or with her mother, or with her father, or in his own house with his brothers, in a suitable place that does not harm her, and there is no harm in that. It is not a condition that she be independent, unless there was a condition in the marriage contract. If it was a condition upon him in the contract that he would provide her with a separate house, then the Muslims are bound by their conditions. If it was a condition upon him in the contract that he would place her in a separate house, then that is fine. Otherwise, she resides with her family, or with her parents, or with her brothers, in a suitable place, if the house is suitable and spacious enough for everyone. Yes.
