Question:
Our sister says: During one of the spring holidays, we went to perform 'Umrah. On the way, one of us started her period. When we reached the miqat, she asked me whether she should enter the state of ihram or not. Out of ignorance, I told her: "Do not enter ihram." So she did not enter ihram, and we continued until we reached the House of Allah. She was very tired, so she entered the Haram with us and sat there while we went to perform 'Umrah. After we finished, my father went to look for an apartment for us, but he was delayed for a long time and found nothing because of the large number of visitors. We were forced to sleep in the Haram, and the one with the legal excuse also slept with us in the Haram. Is she sinful for that? And what is obligatory for her when she entered the Haram and slept in it? May Allah reward you with good.

Answer:
If she is compelled, she owes nothing. If she is compelled, she owes nothing. It is obligatory for her to try hard, perhaps she will find a place outside the Haram, outside the mosque. If she is afraid and does not find one, there is no blame on her—if Allah wills—because she is compelled. Yes.
And Allah the Exalted says:
while He has explained in detail to you what He has forbidden you, excepting that to which you are compelledوَقَدْ فَصَّلَ لَكُمْ مَا حَرَّمَ عَلَيْكُمْ إِلَّا مَا اضْطُرِرْتُمْ إِلَيْهِ
[Al-An'am: 119] Because what is upon her is a mistake; if she went without knowledge, there is no blame on her until she finds a place outside the mosque. Yes.

The presenter : May Allah bless you and reward you with the best reward, but it is upon her and her guardian to try hard, even if it is far from the Haram.

The Shaykh : Yes, it is upon them to try hard until they place her in a safe place, if they know her condition.

The presenter : May Allah bless you, what is upon the woman in the situation described? Many of our sisters send to this program and say: We were too shy to mention this to the guardians?

The Shaykh : No, it is not permissible for them; the explanation is necessary. There is no shyness in this; this is a matter that Allah has prescribed for the daughters of Adam. The explanation is necessary. If she has the excuse, she says: "I have an excuse," so that a place outside the mosque can be sought for her. Yes.

The presenter : Should they wait, Your Eminence, until this period ends so she can enter ihram and perform 'Umrah, or should they cancel the idea of 'Umrah entirely?

Answer : That is up to them. If it causes them harm, there is no objection to them returning with her without her being in ihram. It is permissible for them to return with her, and later she returns to enter ihram with her guardian. She returns to perform her 'Umrah with her guardian. But if it does not cause them harm, they should count it as a good deed and be patient until she performs her 'Umrah. She purifies herself and performs her 'Umrah, and they are in a great state of goodness.
As for if it causes them hardship, she returns with them while in ihram, and then her mahram, her husband or her brother, returns with her until she performs the 'Umrah for which she entered ihram.

The presenter : May Allah bless you, if she did not enter ihram, like our sister?

The Shaykh : If she did not enter ihram, there is no blame. If she has her period and did not enter ihram, there is nothing wrong with her entering with them while not in ihram.

The presenter : May Allah bless you, so what do you advise, Your Eminence?

The Shaykh : If she has her period and she fears that it will be a hardship for them, she should not enter ihram.

The presenter : She should not enter ihram.

The Shaykh : She should not enter ihram.

The presenter : You advise every Muslim woman.

The Shaykh : She stays with them while menstruating without ihram so that she does not cause them hardship.

The presenter : May Allah bless you, if she reaches the miqat and she has an excuse, it is upon her not to enter ihram.

The Shaykh : Unless they allow her.

The presenter : To stay until she performs 'Umrah.

The Shaykh : If they allow her to enter ihram and that they wait for her, yes.

The presenter : May Allah bless you, so the place of the miqat is the place of negotiation in this matter.

The Shaykh : Yes. The miqat, yes.
