Q: My wife and I entered the state of ihram for 'Umrah by plane from Cairo to Jeddah. After entering ihram, and while at Jeddah Airport, my wife began menstruating. Due to my ignorance of the ruling, I exited my state of ihram and took off the ihram clothes. We completed our journey from Jeddah to Dammam and did not go to Makkah. This was about four months ago. Then, in Ramadan this year, my wife and I performed 'Umrah – by the grace of Allah – I hope you will kindly clarify the legal ruling and what I should do now?
A: It was obligatory for you to perform the 'Umrah and not to cancel it. Since your rejection of the intention of ihram and wearing of regular clothes does not change the reality in any way, as the ihram remains and has not been annulled, your second 'Umrah is considered a continuation of your first 'Umrah. However, if you had sexual intercourse during this period before performing the 'Umrah, then you must perform another 'Umrah; as a make-up for the 'Umrah that was invalidated by intercourse, from the miqat from which you entered ihram for the first 'Umrah. And you must pay a fidyah, which is a sheep for each of you, to be slaughtered in Makkah and distributed to the poor of the Haram.
