The ruling on one who made agreements with his guarantor and the guarantor did not fulfill them

Machine translationRead the Arabic original
Question:
A letter sent by a listener, (A. S. D), says: I work as an engineer in an organization in one of the regions of the Kingdom, and I contracted with my guarantor, and he agreed with me on material and moral agreements, but after a year passed, he broke some of the material and moral agreements. Please advise me on what I should do? May Allah reward you with good.

Answer:
You must take his case to the court, seeking the Shari'ah, unless you and he reconcile, or some of the brothers reconcile between you; well, reconciliation is better, so if it is facilitated for someone to reconcile between you by you forgiving some of your right, or him fulfilling the entire right.
So the point is: reconciliation is good if it is facilitated, if reconciliation is not facilitated and he refuses; then you have no option but the court, you take your case to the court, and what the court sees is sufficient, if Allah wills.

The presenter : May Allah bless you.

The Shaykh: If you are in a land governed by the Shari'ah, if you are in a land governed by the Shari'ah.

The presenter: He says: that he is in one of the regions of the Kingdom, may Allah reward you with good.

The Shaykh: ........ the court and praise be to Allah, yes.

The presenter: Praise be to Allah, may Allah bless you.
