Question:
To the honor of our father, our esteemed Shaykh, the scholar Abdul Aziz ibn Baz (may Allah preserve him and grant him scrupulousness).
My brother passed away at the age of 18. He was negligent in prayer and lazy about it; sometimes he would pray and sometimes he would leave it. He also broke his fast for approximately 15 days of Ramadan without a valid religious excuse.
Should I fast on his behalf? Should I perform Hajj on his behalf? Should I seek forgiveness for him and give charity on his behalf?
Please reply quickly due to extreme necessity. May Allah reward you with good, and may Allah benefit us with your knowledge. Your daughter: F. A. from Kuwait.

Answer:
And upon you be peace, and Allah's mercy and blessings. After that:
If your brother’s situation is as you described, namely his laziness regarding prayer and leaving it at times, then it is not permissible for you to perform Hajj on his behalf, nor to give charity on his behalf, nor to make supplication for him. This is based on the saying of the Prophet (peace and blessings be upon him):
Between a man and disbelief and shirk (associating partners with Allah) is the abandonment of prayer.بين الرجل وبين الكفر والشرك ترك الصلاة
and his saying (peace and blessings be upon him):
The covenant that distinguishes between us and them is prayer; so whoever leaves it, he has committed Kufr.العهد الذي بيننا وبينهم الصلاة فمن تركها فقد كفر

. And Allah the Exalted said:
It is not for the Prophet and those who have believed to ask forgiveness for the polytheists, even if they were relativesمَا كَانَ لِلنَّبِيِّ وَالَّذِينَ آمَنُوا أَنْ يَسْتَغْفِرُوا لِلْمُشْرِكِينَ وَلَوْ كَانُوا أُولِي قُرْبَى
[Surah al-Tawbah: 113]. May Allah guide you and grant us and you beneficial knowledge and action upon it. He is the best of those asked. And peace be upon you and the mercy of Allah and His blessings.
