Ruling on Delaying the Fajr Prayer Without an Excuse

Machine translationRead the Arabic original
Question:
Unfortunately, some people do not get up for the Fajr prayer, but when it is time for work, they get up and delay the Fajr prayer for the sake of work?

Answer:
This is a great calamity and a great evil in which many Muslims have fallen; we seek refuge in Allah from that. A person gets up for his worldly needs and the rights of the created, but does not get up for the right of Allah the Exalted. If such a person deliberately commits this act, it is apostasy from Islam according to the most correct of the scholars' opinions; because he deliberately left the prayer in its time. The Messenger of Allah (peace and blessings be upon him) said:
Between a man and disbelief and shirk (associating partners with Allah) is the abandonment of prayer.بين الرجل وبين الكفر والشرك ترك الصلاة
narrated by Muslim. He also said (peace and blessings be upon him):
The covenant that distinguishes between us and them is prayer; so whoever leaves it, he has committed Kufr.العهد الذي بيننا وبينهم الصلاة فمن تركها فقد كفر
Sunan Ibn Majah 1079Sahih (Darussalam)
reported by Imam Ahmad and the people of the four Sunan collections from Buraydah ibn al-Husayb (may Allah be pleased with him) -with a sound chain- along with other hadiths. The majority hold that it is disbelief less than disbelief for one who does not deny its obligation, and the correct view is that it is major shirk, and denying the obligation is independent disbelief by the consensus of the Muslims, even if he does not leave it. The disagreement is only regarding leaving it without denying its obligation. The correct view is that leaving it is major shirk even if he does not deny its obligation; due to these two hadiths and the verses and hadiths that came with their meaning.
And Abdullah ibn Shaqiq al-Aqili, who was a distinguished Tabi'i, said: The Companions of the Prophet (peace and blessings be upon him) did not consider any act of worship whose abandonment is disbelief except the prayer.
As for leaving zakah, it is a great major sin and a crime, but it is not major shirk. Likewise, leaving fasting and Hajj for one who does not deny the obligation of zakah, fasting, and Hajj; because the Prophet (peace and blessings be upon him) informed in authentic hadiths that the one who leaves zakah will be punished with his state on the Day of Resurrection, then he will see his path, either to Paradise or to the Fire. This indicates that he is not a disbeliever merely by leaving zakah. But the prayer is a greater matter; it is the pillar of Islam and the greatest of the pillars after the two testimonies. The texts came that leaving it is disbelief. So if he sleeps through Fajr and deliberately does not set an alarm except for the time of work, then he is deliberately leaving it. We ask Allah for safety. And perhaps if his wife or someone else woke him up, he would not respond to that. So this person should first be given a discretionary punishment (he should be disciplined if his case is referred to the state), then he should be asked to repent. If he repents, well and good; otherwise, he must be killed.
Allah the Exalted said:
But if they should repent, establish prayer, and give zakah, let them [go] on their wayفَإِنْ تَابُوا وَأَقَامُوا الصَّلَاةَ وَآتَوُا الزَّكَاةَ فَخَلُّوا سَبِيلَهُمْ
[Al-Tawbah: 5]. So the verse indicates that the one who does not pray is not left alone. And in the hadith, it is reported from him (peace and blessings be upon him) that he said:
I have been prohibited from killing people who prayنهيت عن قتل المصلين
Sunan Abi Dawud 4928Sahih (Al-Albani)
So this indicates that the one who does not pray is asked to repent, and if he repents, well and good; otherwise, he is killed. There is no power and no strength except with Allah.
