Question:
What is the ruling on one who deliberately delays the Fajr prayer until its time has passed, given that most people set their clocks to the time of their work and perform the prayer afterwards? What is the ruling on this practice of theirs?

Answer:
A warning has already been given regarding this: it is not permissible for a person to delay the prayer beyond its time, whether it is Fajr or any other. It is obligatory for every believer to pray it within its time, and to pray it in the mosque if he is able.
If he is sick or unable, he should pray it at home within its time.
As for the one who is able, he is obligated to pray in congregation; based on the saying of the Prophet (peace and blessings be upon him):
Whoever hears the call for prayer and and does not come (to the mosque for prayer), his prayer will not be accepted from him, unless he has a (legitimate) excuse.مَن سمع النِّداء فلم يأتِ فلا صلاةَ له إلا من عذرٍ

As for setting the clock to the time of work and delaying the prayer until that time; this is a great abomination, and major shirk (associating partners with Allah) according to a group of scholars; because he has resolved to abandon it entirely within its time. For this reason, a group of scholars held that one who does this is a disbeliever, and this is the stronger position, and it is the most correct position; based on his (peace and blessings be upon him) saying:
Between the man and disbelief and shirk (associating partners with Allah) is abandoning the prayerبين الرجل وبين الكفر والشِّرك: ترك الصلاة
, and his (peace and blessings be upon him) saying:
The covenant that distinguishes between us and them is prayer; so whoever leaves it, he has committed Kufr.العهد الذي بيننا وبينهم الصلاة، فمَن تركها فقد كفر

It is necessary to maintain all five: Fajr, Zuhr, Asr, and Maghrib. It is necessary, it is necessary to maintain them all, and to perform them within their times, except if he sleeps through them or forgets them. Allah (Exalted and Majestic is He) does not burden a soul beyond what it can bear. If he sleeps and it is not easy for him to wake up, and he does not hear the clock when he gets up, he prays. Likewise, if he forgets and is preoccupied with it, then he remembers, he prays.
As for deliberately setting the clock to the time of work after the time has passed; this is a great abomination, and this is a resolution to abandon it, and this is disbelief according to a group of scholars, and it is narrated from the Companions of the Prophet (peace and blessings be upon him). Abdullah ibn Shuqayq al-Aqili (may Allah be pleased with him), the noble Tabi'i, said: "The Companions of the Prophet (peace and blessings be upon him) did not consider any of the deeds to be disbelief if abandoned, except for the prayer." They considered abandoning it to be disbelief. We ask Allah for safety.
