What is the ruling on one who has intercourse with his wife during her monthly period?
Answer: It is not permissible for a Muslim to have intercourse with his wife during menstruation or during post-natal bleeding, by the consensus of the Muslims; because Allah the Exalted said:
And they ask you about menstruation. Say, "It is harm, so keep away from wives during menstruation. And do not approach them until they are pure. And when they have purified themselves, then come to them from where Allah has ordained for you. Indeed, Allah loves those who are constantly repentant and loves those who purify themselves."وَيَسْأَلُونَكَ عَنِ الْمَحِيضِ قُلْ هُوَ أَذًى فَاعْتَزِلُوا النِّسَاءَ فِي الْمَحِيضِ وَلا تَقْرَبُوهُنَّ حَتَّى يَطْهُرْنَ فَإِذَا تَطَهَّرْنَ فَأْتُوهُنَّ مِنْ حَيْثُ أَمَرَكُمُ اللَّهُ إِنَّ اللَّهَ يُحِبُّ التَّوَّابِينَ وَيُحِبُّ الْمُتَطَهِّرِينَ
[Surat al-Baqarah: 222]. Therefore, having intercourse with a menstruating woman is among the major sins, so one must beware of it. Whoever does this must repent to Allah . Likewise, with a woman in post-natal bleeding, before she becomes pure, before the blood stops and she becomes pure, the ruling is the same for the woman in post-natal bleeding and the menstruating woman. So whoever does any of that must repent to Allah, turn back to Him the Exalted, and feel remorse for what he has neglected. Along with this, he owes an expiation, which is a dinar or half a dinar, to be given in charity to some of the poor, as came in the hadith of Ibn Abbas:
That the Prophet (peace and blessings be upon him) was asked about one who has intercourse with his wife while she is menstruating. He said: He should give in charity a dinar or half a dinar.أن النبي عليه الصلاة والسلام سئل عمن أتى امرأته وهي حائض، قال: يتصدق بدينار أو بنصف دينار
It was narrated by the five [collections] and authenticated by Ibn Khuzaymah and others. So it is an authentic hadith indicating that whoever has intercourse with his wife while she is menstruating—and likewise the woman in post-natal bleeding is under the same ruling—he has disobeyed his Lord, Mighty and Majestic. So he must repent to Allah, turn back to Him, and feel remorse for what has passed. He must resolve not to return to it. Along with that, he must give in charity a dinar or half a dinar, and he has the choice.
The dinar is a mithqal of gold, its amount being four-sevenths of the Saudi riyal known today. Four-sevenths of the Saudi riyal is called a dinar, and half of it is two-sevenths of the Saudi riyal, or its value in silver. He gives it in charity to some of the poor. So if the Saudi riyal, for example, is worth seventy, then the dinar is forty, and half of it is twenty, to be given in charity to the poor, and so on. That is: two-sevenths of the Saudi riyal is half a dinar, and four-sevenths of the Saudi riyal is the dinar. He gives it in charity to some of the poor if he has intercourse with his wife while she is menstruating. Along with this, he must repent to Allah and turn back to Him, Glorified and Exalted is He; because this is a sin that is not permissible for a man to commit, and it is not permissible for the woman to agree to it or to enable him to do it. She must refrain; because this is cooperation in obedience to Allah and His Messenger. Her negligence in this and her leniency in this is from the category of cooperation in sin and transgression. Yes.

The Shaykh: No, there is no divorce. Intercourse with a menstruating woman does not result in divorce, but it is a sin and a major sin, and he must repent to Allah for it and pay the expiation. Likewise—and may Allah protect us from it—anal intercourse. If he has intercourse with her in the anus, it does not result in divorce, but it is a sin and a crime, and he must repent to Allah for it. So the woman is not to be approached in her anus under any circumstances, nor during menstruation, nor during post-natal bleeding, nor while she is in the state of ihram, nor while she is fasting an obligatory fast. She is not to be approached in these states. Not while she is fasting an obligatory fast, such as Ramadan, making up a missed fast, or a vowed fast. Nor is she to be approached while she is in the state of ihram for Hajj or 'Umrah. Her husband must refrain from that. Nor is she to be approached during the fast of Ramadan, nor during the fast of making up a missed fast, nor during menstruation and post-natal bleeding. The point is: she is not to be approached in these states. So if he approaches her while she is menstruating or in post-natal bleeding, he owes the expiation along with repentance to Allah, Glorified and Exalted is He. Likewise, it is not permissible to approach her in her anus under any circumstances; because the anus is the place of impurity, not the place of intercourse. So it is not permissible to approach women in their anuses; rather, that is forbidden, a sin, and among the major sins. We ask Allah for safety and well-being. Yes.
And she is not divorced by that. That is: she is not divorced by his having intercourse with her in her anus, or during menstruation, or during post-natal bleeding. She is his wife, but he has disobeyed his Lord. So he must repent to Allah for it. And she is not to consent to it. If he wants to have intercourse with her during menstruation or post-natal bleeding or in the anus, she is obligated to refrain from it. It is not permissible for her to enable him to do it. Rather, she must refrain, warn him of Allah, and say: This is not permissible, and this is a major sin, and she must refuse it. Yes.
