Q1: What is the ruling on having intercourse with a woman while she is menstruating ?
A1 : Intercourse with one’s wife while she is menstruating is forbidden; because of the saying of Allah the Exalted:
And they ask you about menstruation. Say, "It is harm, so keep away from wives during menstruation. And do not approach them until they are pure. And when they have purified themselves, then come to them from where Allah has ordained for you.وَيَسْأَلُونَكَ عَنِ الْمَحِيضِ قُلْ هُوَ أَذًى فَاعْتَزِلُوا النِّسَاءَ فِي الْمَحِيضِ وَلاَ تَقْرَبُوهُنَّ حَتَّى يَطْهُرْنَ فَإِذَا تَطَهَّرْنَ فَأْتُوهُنَّ مِنْ حَيْثُ أَمَرَكُمُ اللَّهُ
[Al-Baqarah 2:222]
Therefore, it is not permissible for the husband to have intercourse with his wife while she is menstruating, until she becomes pure from the menstruation with complete purity and performs the ritual bath from her menstruation, due to the aforementioned verse. And whoever has intercourse with his wife during her menstruation or before she performs the ritual bath from the menstruation, he is sinful for committing what Allah has forbidden, and he must make sincere repentance for that evil act, and he owes an expiation, which is to give charity of one dinar or half a dinar to the poor; due to the hadith of Ibn 'Abbas (may Allah be pleased with them both), who said: Regarding the one who has intercourse with his wife while she is menstruating: (He gives charity of one dinar or half a dinar). And the amount of the dinar is four-sevenths of the Saudi riyal. If the exchange rate of
the Saudi riyal is, for example, seventy riyals, then he gives out forty riyals or twenty riyals as charity to some of the poor. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
