Q: A man had intercourse with his wife while she was menstruating or after she had become pure from menstruation or post-natal bleeding, but before she had performed the full ritual bath, out of ignorance on his part. Does he have to pay an expiation, and how much is it? And if the wife becomes pregnant from this intercourse, is it said that the child resulting from this intercourse is a forbidden child?
A: Praise be to Allah alone, and blessings and peace be upon His Messenger, his family, and his Companions... And after that: Intercourse with a menstruating woman in the private parts is forbidden; because Allah the Exalted said:
And they ask you about menstruation. Say, "It is harm, so keep away from wives during menstruation. And do not approach them until they are pure.
وَيَسْأَلُونَكَ عَنِ الْمَحِيضِ قُلْ هُوَ أَذًى فَاعْتَزِلُوا النِّسَاءَ فِي الْمَحِيضِ وَلاَ تَقْرَبُوهُنَّ حَتَّى يَطْهُرْنَand repent to Him, and he must give in charity a dinar or half a dinar as an expiation for what he did, as narrated by Ahmad and the compilers of the Sunan with a good chain from Ibn Abbas (may Allah be pleased with them both), that the Prophet (peace and blessings be upon him) said:
regarding a husband who has sexual intercourse with his wife during her menstruation period, "He must pay a Dinar or half a Dinar in way of charity.”
فيمن يأتي امرأته وهي حائض: يتصدق بدينار أو نصف دينارAnd do not approach them until they are pure. And when they have purified themselves, then come to them from where Allah has ordained for you.
وَلاَ تَقْرَبُوهُنَّ حَتَّى يَطْهُرْنَ فَإِذَا تَطَهَّرْنَ فَأْتُوهُنَّ مِنْ حَيْثُ أَمَرَكُمُ اللَّهُ
