Q1: I had intercourse with my wife while she was menstruating. I should tell you that she had made it clear to me, but she lied, and I did not know she was telling the truth until days later. I ask you to inform me of what is obligatory for me in this matter?
A1: Intercourse with a menstruating woman in the private parts is forbidden; because of the saying of Allah the Exalted:
And they ask you about menstruation. Say, "It is harm, so keep away from wives during menstruation. And do not approach them until they are pure. And when they have purified themselves, then come to them from where Allah has ordained for you.وَيَسْأَلُونَكَ عَنِ الْمَحِيضِ قُلْ هُوَ أَذًى فَاعْتَزِلُوا النِّسَاءَ فِي الْمَحِيضِ وَلاَ تَقْرَبُوهُنَّ حَتَّى يَطْهُرْنَ فَإِذَا تَطَهَّرْنَ فَأْتُوهُنَّ مِنْ حَيْثُ أَمَرَكُمُ اللَّهُ
[Al-Baqarah 2:222]
and the prohibition of the Prophet (peace and blessings be upon him) of that, and the consensus of the Muslim community on its prohibition. So you must seek forgiveness from Allah and repent to Him for having intercourse with your wife while she was menstruating, especially since she had informed you that she was menstruating, so it was obligatory for you to be cautious and verify before intercourse. You must also give charity of a dinar or half a dinar as expiation for what occurred from you, based on what was narrated by Ahmad and the people of the Sunan with a good chain from Ibn Abbas (may Allah be pleased with them both),
That the Prophet (peace and blessings be upon him) said regarding the one who has intercourse with his wife while she is menstruating: "He should give charity of a dinar or half a dinar."أن النبي -صلى الله عليه وسلم- قال في الذي يأتي امرأته وهي حائض: "يتصدق بدينار أو نصف في دينار
whichever of them you give is sufficient for you. The amount of the dinar is four shares out of seven shares of the Saudi riyal. So if the exchange rate of the Saudi riyal is, for example, seventy riyals, you must give out twenty or forty, and give it in charity to some of the poor. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
