Question:
He also asks and says: A man was working for us, and he stayed for a period of time. One day at work, he was working under an earthen wall, and it collapsed on him, and his appointed time came, and he died. The employer wanted to give us a sum of money, that is, the blood money of the deceased. Are we allowed to take it and build a mosque with it, or how do you guide us? May Allah reward you with good.

Answer:
If the employer did not neglect anything, then he owes no blood money, and this was his appointed time. But if he was negligent in that, such that the wall was on the verge of collapsing, and he did not inform him that it was on the verge of collapsing, this is a matter for consideration, and it should be referred to the judge, to the court.
As for if he volunteered the blood money, and they did not demand blood money from him, and there was no dispute between them, but he volunteered the money for them; then there is no blame in taking the money, and they may dispose of it if the employer volunteered the money and they did not sue him, but he himself volunteered it; then he is doing a good deed in this, and may Allah reward him with good. There is no blame in building a mosque with it if you are of sound mind. There is nothing wrong with this for the heirs. If they wish, they may build a mosque with it, and if they wish, they may eat it, and if they wish, they may give it in charity. This is what is theirs to dispose of, however they wish, if they are of sound mind. This is for the heirs. But if they are minors, then it is for them, and no one may dispose of it, but it remains for them. The one of sound mind among them may dispose of his share without blame. Yes.
