The Ruling on Crying over the Dead
Machine translationRead the Arabic original
Question:
The questioner (M. S. Al-Maliki) says: What is the ruling on crying over the deceased after his death, without tearing clothes, or uttering forbidden things, but rather crying out of sadness and humility? Will this deceased be punished in his grave because of this crying? We ask for an explanation of this, may you be rewarded.
Answer:
The forbidden crying is wailing... raising the voice, tearing the garment, and slapping the cheeks. This is what is forbidden. The Prophet (peace and blessings be upon him) said:Sahih Muslim 103a And he (peace and blessings be upon him) said: Sahih Muslim 104a.
The wailer is the one who raises her voice at the time of calamity, the tearer is the one who tears her garment at the time of calamity, and the shaver is the one who shaves her hair at the time of calamity, or plucks it out. This is what is forbidden. As for the tears of the eye, and crying with the tears of the eye, there is nothing wrong with it. He (peace and blessings be upon him) said in the authentic hadith when his son Ibrahim died:Sahih al-Bukhari 1303 And he (peace and blessings be upon him) said: Sahih Muslim 924 and he pointed to his tongue, may peace and blessings be upon him.
So the forbidden thing is raising the voice with the tongue, which is wailing. As for ordinary crying without raising the voice; there is nothing wrong with it. Yes.

The forbidden crying is wailing... raising the voice, tearing the garment, and slapping the cheeks. This is what is forbidden. The Prophet (peace and blessings be upon him) said:
He is not one of us (one among the Ummah of Islam) who beat the cheeks or tore the front opening of the shirt or uttered the slogans of (the days of) Jahiliya (ignorance).
ليس منا من لطم الخدود، أو شق الجيوب، أو دعا بدعوى الجاهليةI have no concern with one with whom the Messenger of Allah (ﷺ) has no concern, Verily the Messenger of Allah (ﷺ) has no concern with that woman who wails loudly, shaves her hair and tears (her garment in grief).
أنا بريء من الصالقة والحالقة والشاقةThe wailer is the one who raises her voice at the time of calamity, the tearer is the one who tears her garment at the time of calamity, and the shaver is the one who shaves her hair at the time of calamity, or plucks it out. The eyes are shedding tears and the heart is grieved, and we will not say except what pleases our Lord, O Ibrahim ! Indeed we are grieved by your separation.
العين تدمع، والقلب يحزن، ولا نقول إلا ما يرضي الرب، وإنا بفراقك يا إبراهيم لمحزونونAllah does not punish for the tears that the eye sheds or the grief the heart feels, but He punishes for this (pointing to his tongue), or He may show mercy.
إن الله لا يعذب بدمع العين، ولا بحزن القلب، وإنما يعذب بهذا أو يرحمSo the forbidden thing is raising the voice with the tongue, which is wailing. As for ordinary crying without raising the voice; there is nothing wrong with it. Yes.
