Question:
I, praise be to Allah, pray all the prayers in the mosque except for Fajr, for I always pray it after the sun rises; the reason for this is that I am asleep, so am I sinful for that?
Give us your rulings, may you be rewarded, and the owner of this message is the listener Abdullah Awadah from Amman, Jordan.
Answer:
It is obligatory for you, O Abdullah, to pray in the mosque at Fajr with the congregation, like the rest of the prayers, and it is not permissible for you to delay it until the sun rises; rather, this is a great evil, and rather, it is major shirk according to a group of the scholars of knowledge, may Allah grant us safety, if you resolve upon it and are determined about it. The obligatory thing for you is to fear Allah, and to pray with the people the prayer in its time, Fajr and others, and you must fear Allah by not staying up late until you rise for the prayer, and you must also seek help with the clock that helps you with that, or with some of your household until they wake you up, or set the clock near Fajr until you rise; because it is one of the means of help for this good, the ticking clock... set it before Fajr so that you seek help with it for that.
So it is obligatory for you to take the means that help you to pray with the congregation Fajr and others, and it is never permissible for you to be lax in this matter, rather this is one of the characteristics of the people of hypocrisy, this action is one of the characteristics of the people of hypocrisy, we seek refuge in Allah. He the Exalted said: [Al-Nisa: 142] So it is obligatory for you to beware of their characteristics, and He the Exalted said about them: [Al-Nisa: 145] And the Prophet (peace and blessings be upon him) said: Sunan Ibn Majah 797Sahih (Darussalam).
So fear Allah, and beware of being lax with any of the five prayers, Fajr and others, and you must fear Allah in performing them in the mosque in congregation, with your brothers; due to the saying of the Prophet (peace and blessings be upon him):Bulugh al-Maram 2:308 It was said to Ibn Abbas: "What is the excuse?" He said: "Fear or illness." And a blind man came to him (peace and blessings be upon him) and said: "O Messenger of Allah, I have no guide to lead me to the mosque, so do I have a dispensation to pray in my house?" He said to him (peace and blessings be upon him): Sahih Muslim 653 He said: Yes. He said: A blind man who has no guide is said to him: ?! How about this seeing, healthy, sound man?!
So it is obligatory for every Muslim to fear Allah, and to pray in congregation at all times, and to beware of delaying them from their time, even if he is sick, he prays them in the time, he does not delay them from the time even if he is sick, in the house he prays them in their time, so how about the healthy one?! May Allah grant us safety and well-being, yes.

إِنَّ الْمُنَافِقِينَ فِي الدَّرْكِ الأَسْفَلِ مِنَ النَّارِ وَلَنْ تَجِدَ لَهُمْ نَصِيرًاThe most burdensome prayers for the hypocrites are the 'Isha' prayer and the Fajr prayer. If only they knew what (reward) there is in them, they would come to them even if they had to crawl.

Whoever hears the call for prayer and and does not come (to the mosque for prayer), his prayer will not be accepted from him, unless he has a (legitimate) excuse.
