The Ruling on Being Lax in the Fajr Prayer Until Its Time Has Passed
Machine translationRead the Arabic original
Question:
This questioner from Yemen asks: What is the ruling on one who is negligent in performing the Fajr prayer, being lax with it, such that he does not pray it until after the sun has risen? And is he considered among the hypocrites? Please give us a ruling, and may you be rewarded.
Answer:
Whoever intentionally leaves the prayer until its time has passed commits disbelief according to the most correct of the scholars' opinions; due to the saying of the Prophet (peace and blessings be upon him): And those who intentionally delay the Fajr prayer until the sun rises are considered disbelievers by a group of the people of knowledge; because the hadith includes them.
So it is obligatory to be cautious of that, and it is obligatory that it be prayed in its time with the congregation in the mosques. If he prays it at home, it is valid and he is safe from disbelief, but he is a sinner; because he left the congregation and did not pray with the Muslims in their mosques. The Prophet (peace and blessings be upon him) commanded prayer in the mosques, and he (peace and blessings be upon him) said in the authentic hadith:Bulugh al-Maram 2:308 It was asked of Ibn Abbas: What is the excuse? He said: "Fear or illness."
A blind man came to him and said: "O Messenger of Allah! Do I have a dispensation to pray in my house?" He said (peace and blessings be upon him):Sahih Muslim 653 He said: Yes. He said: A blind man was ordered to respond and pray in the congregation.
And he (peace and blessings be upon him) said:Sunan Ibn Majah 791Sahih (Darussalam).
And Ibn Mas'ud (may Allah be pleased with him)said: "I have seen us, and none would lag behind it—meaning the congregation in the mosques—except a known hypocrite or a sick person." We ask Allah for well-being.
So it is obligatory to be cautious, and it is obligatory that it be performed with the Muslims in the mosques, and it is not permissible to lag behind it in the houses. We ask Allah for guidance for all of us. Yes.

Between a man and disbelief and shirk (associating partners with Allah) is the abandonment of prayer.
بين الرجل وبين الكفر والشرك ترك الصلاةSo it is obligatory to be cautious of that, and it is obligatory that it be prayed in its time with the congregation in the mosques. Whoever hears the call for prayer and and does not come (to the mosque for prayer), his prayer will not be accepted from him, unless he has a (legitimate) excuse.
من سمع النداء فلم يأت فلا صلاة له إلا من عذرA blind man came to him and said: "O Messenger of Allah! Do I have a dispensation to pray in my house?" He said (peace and blessings be upon him):
Do you hear the call to prayer?
هل تسمع النداء بالصلاة؟Then respond.
فأجبAnd he (peace and blessings be upon him) said:
I was thinking of commanding that the call to prayer be given, then I would tell a man to lead the people in prayer, then I would go out with some other men carrying bundles of wood, and go to people who do not attend the prayer, and burn their houses down around them.
لقد هممت أن آمر بالصلاة فتقام، ثم آمر الرجل فيؤم الناس، ثم أنطلق برجال معهم حزم من حطب إلى قوم لا يشهدون الصلاة فأحرق عليهم بيوتهمAnd Ibn Mas'ud (may Allah be pleased with him)said: "I have seen us, and none would lag behind it—meaning the congregation in the mosques—except a known hypocrite or a sick person."
