The Ruling on a Son Taking from His Father’s Money Without His Knowledge and Then Returning It
Machine translationRead the Arabic original
Question:
One of its questions, O Shaykh, states: A person took from his father’s money without his knowledge out of a dire necessity that compelled him to do so, and then he returned this amount after a period of time, also without his knowledge. What is the ruling on what he did? May you be rewarded.
Answer:
It is obligatory that he not take from his money except with his permission, unless his father was deficient in providing for him. If his father is the one who provides for him, and he is in need, having nothing, and his father is the one who provides for him, he may take from his father’s money what he needs for his maintenance, without extravagance, such as food or money for clothing, without extravagance, if his father is stingy and deficient. In that case, he may take what completes his maintenance. However, taking wealth in excess of this for his trade or for other reasons is not permissible; he may not take it. He does not take except with permission, because the wealth of others is forbidden to him. The Prophet (peace and blessings be upon him) said:Sunan Ibn Majah 3933Sahih (Darussalam).
A person may not take from his brother’s money except with a right, even if he claims he will return it, or even if it is in the form of a loan, except with his permission. However, if it concerns his food, drink, and clothing, because his father was deficient in meeting his needs, he may take the amount of his need, in his clothing, food, and drink.
And a wife may take if he is deficient in providing for her; she may take the amount of her need without excess. The evidence for this is what is established in the two Sahihs, from Hind bint 'Utbah ibn Ri'ab, the wife of Abu Sufyan ibn Harb, that she said: "O Messenger of Allah! Abu Sufyan is a stingy man who does not give me from his maintenance what suffices me and my children. Is there any sin on me if I take from his money without his knowledge?" The Prophet (peace and blessings be upon him) said:Sahih Muslim 1714a meaning: even without his knowledge, yes.
