Ruling on a woman taking from her stingy husband's money

Machine translationRead the Arabic original
Question:
The questioner says: Her husband is stingy and does not give her what is sufficient for her and her children for household expenses, school supplies, and other things. Is it permissible for her to take from his money without his knowledge?

Answer:
Yes, if he falls short in providing for the household, she may take from his money without his knowledge. If he falls short in providing for her and her children, she may take what is customary, without extravagance or waste, but in a customary manner. This is because Hind bint 'Utbah, the wife of Abu Sufyan (may Allah be pleased with them both), said: "O Messenger of Allah, Abu Sufyan is a stingy man who does not give me enough maintenance for myself and my children. May I take from his wealth what is sufficient for me?" He said:
Take from his property what is customary which may suffice you and your children.نعم. خذي من ماله بالمعروف ما يكفيك، ويكفي بنيك
Sahih Muslim 1714a
Take from his property what is customaryخذي من ماله بالمعروف
Sahih Muslim 1714a
meaning: without extravagance or waste. Yes.

The presenter: So, O Shaykh, some of the sisters ask: Is maintenance fixed or specific?

Answer: It is not fixed; it depends on need. It varies according to high or low prices, the needs of the children, their number, whether many or few, and the need... in a moderate way, just as Allah (Exalted and Majestic is He) said regarding His righteous servants:
And [they are] those who, when they spend, do so not excessively or sparingly but are ever, between that, [justly] moderateوَالَّذِينَ إِذَا أَنفَقُوا لَمْ يُسْرِفُوا وَلَمْ يَقْتُرُوا وَكَانَ بَيْنَ ذَلِكَ قَوَامًا
[Al-Furqan: 67] And He (Exalted and Majestic is He) said:
And do not make your hand [as] chained to your neck or extend it completely and [thereby] become blamed and insolvent.
[Al-Isra: 29]. The restrained one is the stingy one, and the one who gives without limit is the extravagant one, the wasteful one. Yes.

The presenter: May Allah reward you.
