A message was sent from Iraq by one of the sisters there, saying: (S. S.) Our sister asks and says: When is it permissible for a man to be alone with a woman? And is it permissible for him to be alone with her after her father and his father agreed to accept their marriage, in the presence of two other witnesses? In other words, have they become husband and wife, knowing that this contract has not been registered in the court?
Answer: Seclusion with a foreign woman is forbidden; due to the saying of the Prophet (peace and blessings be upon him):
No person should be alone with a woman except when there is a Mahram with herلا يخلون رجل بامرأة إلا ومعها ذو محرم
Sahih Muslim 1341a
and his saying (peace and blessings be upon him):
A man should not be alone with a woman, for Satan is the third among them.لا يخلون رجل بامرأة فإن الشيطان ثالثهما
Al-Mustadrak lil-Hakim 2:94
But if the contract is completed and the marriage is finalized by the guardian and the suitor in the presence of witnesses, she becomes his wife. If he is alone with her, he owes nothing. However, he should refrain from having intercourse with her until he enters into her with the legal entry; so that it is not thought that she is from another man. In such cases, it should be that his intercourse with her and his sexual connection with her occurs after the official seclusion that her people acknowledge.
As for his being alone with her, there is no blame on him for being alone with her; because she is his wife. But intercourse with her should be delayed until the official entry that people know, so that no accusation occurs if she becomes pregnant, and it is said: This is not from her husband, or he denies it, or something similar. We ask Allah for safety. Yes.
