In his letter, he says: I heard from some people whom I believe have knowledge of the religion that if a Muslim travels to any country and is absent from his wife for a year, and she knows his location, and he corresponds with her and she sends to him and he sends her maintenance, then if he goes to his home after a year, it is not valid for him to be with her before he gives her money called: "muhallilah," and she is free with this money to dispose of it as she wishes, and after he gives her the money, the marriage is completed and it is permissible for him to approach her. Please inform us of the validity of this. May Allah reward you.
Answer: This is something with no basis. This money has no basis. If he is absent from her and has not divorced her, she is his wife, even if he is absent for more than a year, she is his wife, unless he divorces her or it is annulled from him. So as long as she is in his possession and in his marriage bond, and it has not been annulled by the religious judge, and he has not divorced her, then she is his wife. And if he returns from his journey, she is his wife, and he may have contact with her and have intercourse with her. And if he does not give her money, the maintenance that Allah has made obligatory for her is sufficient. So the result is that this thing mentioned by the questioner, that she is not lawful for him after his arrival until he gives her money, has no basis. Rather, she is his wife and is lawful for him as long as he has not divorced her and it has not been annulled from him, and the religious judge has not annulled her due to his absence from her, or due to his failure to provide maintenance for her, or the like.
