This is a letter from (M. H. Q.) from Riyadh, in which its author says: I am a woman married to a man who does not pray, and I have borne him two sons. I am a woman who prays and maintains my worship. I have called him to prayer many times, but he refuses and says to me: "Religion is dealing and morals, not movements or rak'ahs." He is upright in the rest of his life matters. My question is: Is my remaining with this man lawful or forbidden, knowing that separating from him would scatter my children and destroy my family? But the fear of Allah makes me ask you, and I want to know the ruling of Allah. May Allah reward you?
Answer: It is not permissible to remain with this man who does not pray; because this indicates a lack of his religion or the complete absence of his religion. Prayer is the pillar of Islam, and whoever abandons it intentionally commits disbelief.
Therefore, it is obligatory to distance oneself from him and not to allow him access to yourself. You should go to your family or prevent him from having access to you entirely, until he repents to Allah and until he prays. The Prophet (peace and blessings be upon him) said:Sunan Ibn Majah 1079Sahih (Darussalam) It was narrated by Imam Ahmad and the people of the Sunan with a sound chain from Buraydah (may Allah be pleased with him).
And Muslim narrated in the Sahih from Jabir (may Allah be pleased with him) from the Prophet (peace and blessings be upon him) that he said: So prayer is the pillar of Islam, and whoever abandons it intentionally commits disbelief, may Allah protect us from that.
As for the one who forgets, he makes it up, and the one who sleeps makes it up. But whoever abandons it intentionally is a disbeliever according to the most correct of the scholars' opinions.
And a group of scholars held the view that he does not commit major disbelief by this, but rather his disbelief is minor disbelief; because the Messenger (peace and blessings be upon him) called him a disbeliever. However, this is a weak opinion, a weaker opinion.
And the correct view is that it is major shirk (associating partners with Allah). Abdullah ibn Shaqiq al-Aqili (may Allah have mercy on him) said: He reported from all the Companions that they consider abandoning prayer to be disbelief, and the apparent meaning of what was transmitted from them is that they consider it major shirk (associating partners with Allah).
Therefore, it is obligatory upon you, O sister in Allah, to get rid of this man and not to allow him access to yourself. It is not permissible for you to remain with him until he repents to Allah.
And his saying: "Religion is dealing," is not a correct statement. Rather, good dealing is part of the religion, it is not the religion itself. The religion is good dealing with Allah and with His servants. It is not just dealing. Good dealing and kind dealing, and among the good dealing is performing prayer. So if he means by good dealing with Allah and His servants, then there is no good dealing except by performing the obligations of Allah and abandoning the prohibitions of Allah.
So whoever neglects the obligations of Allah, or neglects prayer, or commits the prohibitions, he has not established good dealing, and he has not come with good dealing. The religion is: good dealing with people in buying and selling, interaction, and companionship, and the like of that, and good dealing with Allah by performing His obligations. It is not just good dealing with people, no, but good dealing with Allah is necessary, by performing His obligations and abandoning His prohibitions (Glorified and Exalted is He) .
Therefore, it is obligatory upon you to fear Allah and to beware of remaining with this man. And we ask Allah for his guidance.
As for if he denies its obligation and says: "It is not obligatory," or if he mocks the worshippers, he commits disbelief by consensus, by the consensus of the Muslims. If he mocks the worshippers or denies its obligation, he commits disbelief by consensus. We ask Allah for safety. Yes.
