This is a message from a confused woman (A. N.) from the vast lands of Allah. She says: I married a man five months ago who is one year older than me. Before agreeing to the marriage, I asked him about prayer, and he answered that he does not pray, but he promised me that he would pray after the marriage, if Allah wills. But unfortunately, after our marriage, I discovered that he did not keep his promise and did not perform the obligatory prayer, except on Friday, when he prays in the mosque. I always invite him to prayer gently because I fear Allah. I have heard that it is not permissible to live with a disbeliever who abandons prayer. Is this true? Another problem is that he works in a shop and steals money from it. He also brings items from this shop to the house, and I use them because I am in great need of them. Do I bear any sin in using them and eating what he brings from the shop? When I see him doing this, I rebuke him for his actions, but he responds by insulting me, cursing me, and cursing my religion and my Lord, may Allah protect us from that. In addition, he does not want children until after three or five years, and he uses the method of coitus interruptus with me, which hurts me and causes me pain. I have suffered with him, and although I love him, I hate his actions. I asked him to divorce me, and we went to the judge, but the judge reconciled us. Everyone promised that he would reform, but unfortunately, it was to no avail. Please advise and guide me on what I should do?
Answer: As long as this husband is in the state you described, namely that he does not pray except on Friday, and that he insults you, insults your religion, and insults your Lord, he is a disbeliever, and it is not permissible to remain with him. Insulting the Lord and insulting the religion is greater and more serious than abandoning prayer. Whoever insults the religion is a disbeliever, and whoever insults the Lord is a disbeliever, by the consensus of the scholars. Whoever abandons prayer is also a disbeliever according to the most correct of the scholars' opinions, even if he does not deny its obligation. This is based on the saying of the Prophet (peace and blessings be upon him):
The covenant that distinguishes between us and them is prayer; so whoever leaves it, he has committed Kufr.العهد الذي بيننا وبينهم الصلاة فمن تركها فقد كفر

And he (peace and blessings be upon him) said:
Between a man and disbelief and shirk (associating partners with Allah) is the abandonment of prayer.بين الرجل وبين الكفر والشرك ترك الصلاة
So prayer is a matter of great importance, and it is the pillar of Islam. Whoever abandons it out of ignorance of its obligation is a disbeliever by the consensus of the Muslims. Whoever abandons it out of laziness and negligence, while knowing that it is obligatory, is also a disbeliever according to the most correct of the scholars' opinions, based on the two aforementioned hadiths and other authentic hadiths. However, insulting the religion and insulting the Lord is greater and more serious.
So it is obligatory for you to distance yourself from him and not to allow him access to you. The marriage, given the situation described, is invalid and does not hold, because he is not qualified for it. A disbeliever does not marry a Muslim woman. Allah the Exalted says:
they are not lawful [wives] for them, nor are they lawful [husbands] for themلا هُنَّ حِلٌّ لَهُمْ وَلا هُمْ يَحِلُّونَ لَهُنَّ
[Al-Mumtahanah: 10] And He the Exalted says:
And do not marry polytheistic men [to your women] until they believeوَلا تُنكِحُوا الْمُشْرِكِينَ حَتَّى يُؤْمِنُوا
[Al-Baqarah: 221] And this man is an associate of partners with Allah by his insulting of the religion and his insulting of the Lord , and he is also a disbeliever by his abandoning of prayer, even if he prays on Friday or prays some of the prayers.
So it is obligatory for you to be wary of him and distance yourself from him, and not to allow him access to you. In addition to this, he also does not care about what is forbidden; he considers what is forbidden to be permissible. He takes money from the one who has entrusted him with it without right, from the money he is entrusted with. He takes from it and brings you what is forbidden. In this, there is much evil, and there is a great affliction. He has many wrongdoings, both disbelief and other than disbelief, disbelief and sin.
So it is obligatory for you to be wary of this man, not to allow him access to you, and to go to your family. You should demand that the judge give you a document dissolving the marriage and separating you from him. We ask Allah for you to be saved from the evil and affliction of this man, and we ask Allah to guide him and return him to Islam. Yes.
