If a husband does not maintain his prayers, meaning he prays some days and leaves them off others, and the same is true for fasting—he is a kind-hearted man and does not prevent his wife from attending gatherings of knowledge or from the freedom to be committed to the religion—what is the ruling on marriage in such a case? If a man does not pray at some times, it is not permissible to remain with him; because leaving the prayer is disbelief. So if your husband does not pray at some times, it is obligatory for you to distance yourself from him, go to your family, and abstain from him until he repents to Allah and prays. This is the correct view according to the scholars.
The second opinion is that he does not become a disbeliever by this; that it is a disbelief less than full disbelief, and that he is a sinner committing a great sin, but he does not become a disbeliever by this unless he denies the obligation. This is a weak and weaker position.
The correct view is that whenever he leaves it intentionally, he becomes a disbeliever by that; due to the saying of the Prophet (peace and blessings be upon him): and his saying (peace and blessings be upon him): Sunan Ibn Majah 1079Sahih (Darussalam) And every woman whose husband leaves the prayer must separate from him and prevent him from having access to her until he repents to Allah.
