The ruling on one who did not enter the state of ihram from his home country's miqat out of ignorance
Machine translationRead the Arabic original
From the village of al-Shaybata in the Arab Republic of Yemen, Zabydi district. The listener: Ahmad 'Umar al-Shajani sent a message saying: I am a young Muslim from the Arab Republic of Yemen. I have performed Hajj several times, praise be to Allah, but I am uneducated—a man who is illiterate. I performed Hajj on behalf of my father among the repeated Hajj pilgrimages that Allah enabled me to perform in this safe land. I inform you that I did not offer any sacrificial animal in the Hajj; in that I did not know what the meaning of the sacrificial animal is. Am I obligated to offer it or not? But when I understood from the guides and preachers, I thought about this matter and decided to ask your Eminence what is required of me regarding that shortcoming. Please inform me, may Allah reward you?
Then, when I come from Yemen, I do not enter the state of ihram from the miqat designated for the people of Yemen, which is Wadi 'Aqaba; in that I pass this miqat, and when I reach the city of Jeddah, I enter the state of ihram from there and go to the Noble Mecca. But I understood that it is obligatory to enter the state of ihram from the miqat where the people of Yemen enter the state of ihram, so I decided to ask your Eminence what is also required of me in that. May Allah reward you with good?
Answer: It is obligatory for you to offer a sacrificial animal to be slaughtered in Mecca for leaving the state of ihram from the miqat, for every journey in which you performed 'Umrah or Hajj and did not enter the state of ihram from the miqat of Yemen. You must slaughter a sacrificial animal in Mecca for the poor for each one, along with repentance and seeking forgiveness.
As for the expiation, if when you arrive in Mecca for Hajj you enter the state of ihram for Hajj alone and remain in your state of ihram and do not perform 'Umrah, then there is no expiation on you. But if when you performed Hajj in your pilgrimages you entered the state of ihram for 'Umrah after Ramadan and then performed Hajj, then you owe an expiation for all the pilgrimages in which 'Umrah was performed after Ramadan. For every Hajj in which 'Umrah was performed after Ramadan, you owe a sacrificial animal to be slaughtered in Mecca, and you may eat from it and feed others.
As for the pilgrimages in which there was no 'Umrah, but you come and enter the state of ihram from the miqat for Hajj alone and remain in your state of ihram until you complete the Hajj, there is no expiation on you for that, and praise be to Allah.
The presenter: May Allah reward you with good.
