The ruling on performing Hajj on behalf of a father who did not perform Hajj due to inability

After this, a letter was sent by its owner who says: I am a worker in al-Hulwa, Hawtat Bani Tamim Governorate. My father passed away while he was poor and had not performed the Hajj of Islam. I have a family and am of moderate means. Should I perform Hajj on his behalf from my family's expenses, or not? Please inform us, may Allah reward you.
Answer: If he died while he was poor, he does not owe Hajj; because Allah says: [Surah Al-Imran: 97]. So if your father passed away while he was unable to perform Hajj, he owes nothing, and you likewise owe nothing. If the provision you have is little, equal to the family's expenses, then you do not owe Hajj, even you.
As for if it becomes easy for you to perform Hajj on his behalf from surplus wealth after you have performed Hajj for yourself, this is from dutifulness to parents. The Prophet (peace and blessings be upon him) was asked; a man asked him and said: , and another asked him; a woman asked him and said: , and another asked him, saying: . All of this is from dutifulness to parents. So if you are able, it is prescribed for you to perform Hajj on his behalf after you have performed Hajj for yourself. But if you are not able, Allah does not burden a soul beyond its capacity.
