Question:
The listener (M. S. A.) from Egypt sent a message containing a number of questions. In one of them, he asks: What is the ruling on one who performs ghusl for janabah without performing wudu' at the beginning of the ghusl? And is one who performs wudu' at the beginning of the ghusl required to wash his feet or not?

Answer:
If one performs ghusl for janabah intending both the major and minor states of ritual impurity, it suffices for both. However, if he intends only the major state, then what he should do is perform wudu'. Some scholars have held that it suffices for wudu' because the minor state is included in the major state. But the apparent meaning of the hadiths is contrary to that, due to his saying (peace and blessings be upon him):
Actions are only by intentionsإنما الأعمال بالنيات
and he did not intend anything but the major state.
It is obligatory for him to perform wudu' after that, the wudu' prescribed by the Shari'ah.
The Sunnah is to begin with wudu'; this is the Sunnah, to begin with wudu' and then perform ghusl; this is the Sunnah. And if he performs wudu' before that, then if he leaves his feet and then completes the ghusl, there is no harm. And if he completes his feet, that is better. It is established from him (peace and blessings be upon him) both this and that. It is established from him in the hadith of A'ishah that he performed wudu' and completed the wudu', and it is established from him in the hadith of Maymunah that he left the two feet until he finished, then he washed them in another place.
So for him to perform a complete wudu', then perform ghusl, and then after this wash his feet again, this would be better. And if he leaves them until he completes the ghusl, then completes them, there is no harm in that; because the ghusl has now become shared between the wudu' and the ghusl. So if he performs the wudu' prescribed by the Shari'ah except for the feet, then completes his ghusl, then completes his feet, there is no harm. But as mentioned earlier, for him to complete the wudu' including the feet, then complete the ghusl, this is what is better. Then after that, he washes his feet in another place, if that is facilitated. If it is the same place, and there is nothing concerning the feet, such as if it is tiled, he washes them in the place, and praise be to Allah.
And for him to have washed them in another place—upon him be peace and blessings—is understood to be because he moved from the place where something of its mud and dust might have stuck to them, so he washes them in another place for this reason. This is the apparent meaning, and Allah knows best. Yes.
