The Ruling on Performing the Witr Prayer After the 'Isha' Prayer
Machine translationRead the Arabic original
Question:
This is a questioner, your brother in Allah, Yahya Dail. In his first question, he says: One of the brothers told me that the witr prayer after 'Isha' is a recommended practice (sunnah), and if I leave it, there is nothing on me. I have started doing that, so please give us a ruling on my action, may you be rewarded.
Answer:
Yes, it is a recommended practice (sunnah) if one fears that he will not be able to get up in the last part of the night; because the Messenger of Allah (peace and blessings be upon him) advised Abu Hurayrah and Abu al-Darda' to fast three days of every month, and to perform the witr before sleeping.
And it appears—may Allah know best—that it was difficult for Abu Hurayrah to get up in the last part of the night; because he would study knowledge in the first part of the night, studying hadith, so the Prophet (peace and blessings be upon him) advised him to perform the witr in the first part of the night, and so it was with Abu al-Darda'.
As for the one who hopes to be able to get up in the last part of the night, that is better; due to what came in the authentic hadith from Jabir (may Allah be pleased with him) from the Prophet (peace and blessings be upon him) that he said:Sahih Muslim 755a It was narrated by Muslim. This indicates that if it is easy for him to get up in the last part of the night, that is better. The Prophet (peace and blessings be upon him) performed the witr from the first part of the night, from the middle of it, and from the last part of it; all of it is permissible, and praise be to Allah. But if it is easy for him to do it in the last part of the night, that is the best.

If anyone is afraid that he may not get up in the latter part of the night, he should observe Witr in the first part of it; and if anyone is eager to get up in the last part of it, he should observe Witr at the end of the night, for prayer at the end of the night is witnessed (by the angels) and that is preferable.
