Question:
The questioner: This is Safiyyah from Syria - Damascus asking: Peace be upon you and Allah's mercy and blessings. My question, O Shaykh: What is the ruling on forcing a girl to marry a man she absolutely does not want and who is not suitable for her? Is it a valid marriage? Or is it invalid in Islamic law?

Answer:
It is not permissible to force a girl to marry. The Prophet (peace and blessings be upon him) said:
A lady slave should not be given in marriage until she is consulted, and a virgin should not be given in marriage until her permission is granted.لا تنكح الأيم حتى تستأمر، ولا تنكح البكر حتى تستأذن
Sahih al-Bukhari 6970
They said: O Messenger of Allah, she is shy. He said:
Her permission is her silenceإذنها سكوتها
So her father or anyone else has no right to force her. Rather, it is obligatory to take her permission: if she is a virgin, her silence is her permission, and if she is a previously married woman, her explicit permission is required. As for forcing her, she is not to be forced to marry someone she does not want, whether she is a virgin or a previously married woman. Her father or her guardians have no right to force her; because the Messenger (peace and blessings be upon him) forbade this. Yes.
