His father died and he had not performed Hajj; is it permissible to give someone money and tell him to perform Hajj on behalf of my father?

Machine translationRead the Arabic original
The questioner : And his father died and he had not performed Hajj; is it permissible to give someone money and tell him to perform Hajj on behalf of his father?

The Shaykh : Why doesn't he perform Hajj on his behalf?

The questioner : He believes it is permissible.

The Shaykh : No one performs Hajj on behalf of another except a son for his father, if his father did not perform Hajj due to a valid religious excuse. However, if the obligation of Hajj fell upon him and he did not perform it, then even the son does not perform Hajj on his behalf, let alone anyone else.

The questioner : As for the case where the son is present and, meaning, did not perform Hajj due to a valid religious excuse.

The Shaykh : Who did not perform Hajj?

The questioner : The father and the son is sick or has—also—a valid religious excuse not to perform Hajj on behalf of his father; is it permissible for someone else to perform Hajj on his behalf?

The Shaykh : No one performs Hajj on behalf of another except if he left a bequest.

The questioner : ... So-and-so to perform Hajj on his behalf. Okay, my Shaykh, this condition, this bequest.

The Shaykh : In execution of the bequest.
