Question:
From al-Qasim, this is a message sent by one of the sisters from there, saying: (M. D.), our sister says: If a person swears an oath while in a state of anger, does his oath constitute a binding oath to do something or to leave something, given that I sometimes do not remember some of the things I swear about? What is the expiation for this? May Allah reward you with good.

Answer:
If a person swears an oath while angry, his case requires detailed examination. If his anger intensified to the point where he lost his consciousness and could not distinguish right from wrong due to the intensity of the anger, such that he could not control himself, then his oath is not established, and nothing is required of him. This is similar to if he pronounces a divorce in a state of intense anger during severe insult, intense quarreling, fighting, or the like, until he loses his consciousness; because in this state, he is similar to the insane and the mentally ill.
As for ordinary anger, it does not prevent the divorce from taking effect, nor does it prevent the establishment of the oath. So if she says, "By Allah, I will not speak to so-and-so," or if a man says, "By Allah, I will not speak to so-and-so," or "I will not visit him," or "I will not respond to his invitation," and even if he is angry, but it is an anger that did not affect his consciousness, and did not reach the level of intensity that alters consciousness and prevents a person from thinking and considering, then he owes the expiation of the oath if he violates his oath. This is based on the saying of the Prophet (peace and blessings be upon him):
and whenever you take an oath to do something and later you find that something else is better than the first, then do the better one and make expiation for your oath.إذا حلفت على يمين فرأيت غيرها خيرًا منها؛ فكفر عن يمينك وأت الذي هو خير

So if he says, "By Allah, I will not visit him," even if he is angry, or "By Allah, I will not speak to him," and then he visits him or speaks to him, he owes the expiation of the oath. Likewise, the woman is the same if she says, "By Allah, I will not speak to so-and-so," or "I will not speak to so-and-so," or "I will not visit so-and-so," or "I will not visit so-and-so," or "I will not buy such-and-such for her," or "I will not give her such-and-such," and then she wants to do the action; she may do it and expiate for her oath. The man and the woman are equal in this matter; because of this authentic hadith, which is his saying (peace and blessings be upon him):
and whenever you take an oath to do something and later you find that something else is better than the first, then do the better one and make expiation for your oath.إذا حلفت على يمين فرأيت غيرها خيرًا منها، فكفر عن يمينك وأت الذي هو خير

By Allah, Allah willing, if I ever take an oath, and then see that another is better than the first, I make expiration for my (dissolved) oath, and do what is better and make expiration.والله إني إن شاء الله لا أحلف على يمين فأرى غيرها خيرًا منها إلا كفرت عن يميني، وأتيت الذي هو خير
