Question:
If a person swears an oath while in a state of anger, is his oath one that entails doing something or leaving something, knowing that I sometimes do not remember some of what I swear about? What is the expiation for this? May Allah reward you with good.
Answer:
One who swears while angry is in a situation that requires detailed explanation:
If the anger intensified in him to the point that he lost his consciousness, and he could not distinguish due to the intensity of the anger—he did not control himself—then his oath is not established, and nothing is required of him, just as if he divorced in a state of intense anger, during cursing, intense quarreling, fighting, and the like, until he lost his consciousness; because in this state, he is most like the insane and the mad.
As for ordinary anger, it does not prevent divorce, nor does it prevent the establishment of an oath. So if she says, "By Allah, I will not talk to so-and-so," or if a man says, "By Allah, I will not talk to so-and-so, or I will not visit him, or I will not respond to his invitation," even if they are angry, but the anger did not affect his consciousness, and it did not reach the limit of intensity that changes consciousness and prevents a person from thinking and looking, then he owes the expiation of the oath if he violates his oath; due to the saying of the Prophet (peace and blessings be upon him):Sahih al-Bukhari 6622.
If he says, "By Allah, I will not visit him," even if he is angry, or if he says, "By Allah, I will not talk to him," and then he visits him or talks to him, he owes the expiation of an oath. Likewise, the woman questioner, if she says, "I will not talk to so-and-so, or I will not visit so-and-so, or I will not buy for her such-and-such, or I will not give her such-and-such," and then she wants to do the action, she may do it and expiate for her oath.
The man and the woman are equal in this; due to this authentic hadith, which is his saying (peace and blessings be upon him):Sahih al-Bukhari 6622, and he said (peace and blessings be upon him): Sahih al-Bukhari 6718.

إذا حلفت على يمين فرأيت غيرها خيرًا منها، فكفر عن يمينك وأت الذي هو خيرIf he says, "By Allah, I will not visit him," even if he is angry, or if he says, "By Allah, I will not talk to him," and then he visits him or talks to him, he owes the expiation of an oath. إذا حلفت على يمين فرأيت غيرها خيرًا منها، فكفر عن يمينك وأت الذي هو خيرBy Allah, Allah willing, if I ever take an oath, and then see that another is better than the first, I make expiration for my (dissolved) oath, and do what is better and make expiration.
والله إني -إن شاء الله- لا أحلف على يمين، فأرى غيرها خيرًا منها، إلا كفرت عن يميني، وأتيت الذي هو خير
