Question:
I am a young man who is able to perform Hajj, and I have not yet performed the Hajj of Islam. My father is preventing me from performing Hajj. What is the ruling on my staying home, and what is the ruling on my father’s refusal to let me perform Hajj?

Answer:
He must perform Hajj even if his father prevents him. The Prophet (peace and blessings be upon him) said:
A creature is not to be obeyed when it involves disobedience to the "Creator.”إنما الطاعة في المعروف، لا طاعةَ لمخلوقٍ في معصية الخالق
Mishkat al-Masabih 3696
. However, he should address him in the best manner, saying: “My father, praise be to Allah, I am able to do this, and it is an obligatory duty upon me. One like you should help me in doing good.” He should also seek the help of his uncles, brothers, or good neighbors until his father agrees. If his father insists on preventing him, there is no obedience to him in that.
But I do not think a Muslim would insist on this if there is good in it. He would not insist. His son is able to perform Hajj, and he prevents him from doing so? This is not the behavior of a believer; it is the behavior of an open sinner or a disbeliever. But if he insists on this despite speaking kindly to him and advising him, there is no obedience to him. He performs Hajj, and he owes nothing.
