What is the ruling on abortion, and what is the obligation of the woman who has aborted?

Machine translationRead the Arabic original
The Shaykh : The news of many astronomers: you will find that our calendar’s month differs from the Saudi calendar, for example, and both calendars are based on astronomical calculations. So the important thing is that this, which is called science, is also subject to error and truth, just as the science of deriving legal rulings is subject to error and truth. If that is the case, it is not permissible for a Muslim man or woman to entrust their matter to the opinion of a doctor, especially if we are not first confident in his specialization in his field, and second—and this is further from trusting him—we do not know if he is committed to his religion and the Shari'ah of his Lord or not. All of this must be considered before it is said to be permissible or not permissible. As for the original ruling, it is that it is not permissible. And the existence of some abnormalities in the creation of some fetuses and children is from the decree of Allah (Mighty and Majestic) in what He creates. So Allah (Mighty and Majestic), as He said in the Noble Qur'an:
You do not see any inequality in the creation of the Most Merciful مَا تَرَى فِي خَلْقِ الرَّحْمَنِ مِنْ تَفَاوُتٍ
, we see a variation other than this variation; we see the white, the brown, the black, the male, the female, the complete, the incomplete, and so on. These are not natural slips as the atheists say, but rather they are the overriding will of Allah (Mighty and Majestic)
the subjugator over His servants الْقَاهِرُ فَوْقَ عِبَادِهِ
[Al-An'am 6:18]
. Therefore, if there is a necessity, in brief, and a Shari'ah necessity, then abortion is permissible, or not. This is what I have.

The questioner : May Allah reward you with good.

The Shaykh : And beware of that.

The questioner : As for the woman, currently, she owes no expiation. And anything else?

The Shaykh : What did she do?

The questioner : She aborted.

The Shaykh : She aborted.

The questioner: Yes.

The Shaykh : Was her abortion with her husband's consent?

The questioner : I do not know, by Allah.

The Shaykh : By Allah, I do not know, just like you.

The questioner : In both cases, meaning whether it was with her husband's consent or without his consent.

The Shaykh : No, there is a difference, because it is not permissible for a wife to disobey her husband in what is an ordinary permissible matter, and even in what is recommended in worship. If the husband does not desire that she stand in night prayer or fast during the day, it is not permissible for her to disobey him. So what can be said about a matter like this abortion, whose original ruling, as we told you just now, is that it is not permissible except for a necessity.

The questioner : If it was with her husband's consent.

The Shaykh : Then the disobedience is much lighter.

The questioner : May Allah reward you with good.

The Shaykh : And beware of that.

The questioner : .

The Shaykh : Peace be upon you and Allah's mercy. Was the speech for you or for him? What were you talking about, Abu Yahya, that they pour wine and then what do they do with it?

The questioner : They bring a slice of meat, they serve it on the table, and they pour a type of wine on it. With alcohol, meaning the remnants of the food remain in the meat.
