Question:
A man was a Christian, then he embraced Islam, and praise be to Allah. His wife is still adhering to her previous religion. What is the ruling on her remaining under his protection while she has not embraced Islam? May Allah reward you with good.

Answer:
As long as she is a Christian, there is no harm; because it is permissible for a Muslim to remain with a woman from the People of the Book, and he may also marry her anew. He may marry her if she is a chaste woman. So if his wife is a chaste woman and he wishes to remain with her, there is no harm. Perhaps Allah will guide her to Islam through His means. And if he wishes to divorce her, there is no harm.
However, if she is not a Christian but a polytheist; then the marriage contract is annulled. When the waiting period ends, the marriage is annulled by his embracing Islam. If she embraces Islam, she is his wife; otherwise, the marriage is annulled. She is then free to marry after she exits the waiting period.
As for if she is from the People of the Book—Jewish or Christian—she remains with him; because it is permissible for a Muslim to marry a chaste woman from the People of the Book. Not marrying her is safer for him and further from evil. So if he separates from her as a precaution, fearing that she might drag him to her religion, that is good. And if he hopes for her Islam and expects her to embrace Islam, he should not hasten. Perhaps Allah will guide her through His means. If the waiting period ends—she menstruates three times—and she has not embraced Islam; the marriage ends, and she becomes free to marry whomever she wishes.
