He also asks and says: My brother lives with me in the house, and he does not pray and he insults the religion. I have spoken with him several times and offered him advice, but he turned away from it. Finally, after I had troubled him with my words, he said to me: I will never pray until I die. Is it permissible for me to eat with him after that and to deal with him? I fear that this disobedience will be the cause of his destruction. What is the means by which I can combat such behavior with this brother? May Allah reward you with good.
Answer: It is obligatory for you to advise him and warn him of the consequences of his action, and to make it clear to him that what he has done is apostasy from Islam. Insulting the religion is apostasy from Islam by the consensus of the Muslims. Likewise, abandoning the prayer is apostasy from Islam according to the most correct of the scholars' opinions. If he denies its obligation, he is a disbeliever by consensus. If he does not deny its obligation but is lazy and does not care, he is a disbeliever according to the most correct of the scholars' opinions, based on the saying of the Prophet (peace and blessings be upon him) in the authentic hadith:Sunan Ibn Majah 1079Sahih (Darussalam) It was narrated by Imam Ahmad and the people of the Sunan with a sound chain from Buraydah (may Allah be pleased with him). And ask Allah for his guidance between you and your Lord, perhaps Allah will guide him through your means. As for remaining with him, absolutely not. Do not be his companion, do not eat his wedding feast, do not respond to his invitation, and do not let him remain with you in your place. Because his state is vile, his speech is impure, and his belief is impure. It is befitting for you to combat him and stay away from him.
And if the country has an Islamic ruling, he is to be brought before the one in authority so that he is given the opportunity to repent. If he repents, well and good; otherwise, he is killed. Because Allah the Exalted says: [At-Tawbah: 5] This indicates that the one who does not pray is not left alone, but is killed if he does not repent. We ask Allah for his guidance, we ask Allah for his guidance, and we ask Allah for your assistance against him with truth, sincerity, and guidance. Yes.
