This is a message we received from the questioner (M. A. A.) from Sudan. In fact, he has several questions in it; we will present some of them, while the answers to others have been repeated in many episodes of the program. He says in his question: I have been married for ten years and have not had a child, and that is the will of Allah, Glorified and Exalted. But the question is: if the source of the lack of children in this case is the man, does he have a sin if he does not tell the woman about it? And is it incumbent upon a person to divorce her? What is the ruling? Please inform us, may Allah reward you.
Answer: If a believer is not granted children, it is not certain that he is infertile. There may be causes that require treatment, for every disease has a cure. If it is confirmed through the experts, the doctors, that he is infertile, the scholars have differed on whether the woman has the right to annul the marriage or not.
If he divorces her to fulfill her request and out of mercy for her, that is good, without the need for litigation, if she requests it. The best, most preferable, and safest course for him is to divorce her if she requests a divorce, or to satisfy her with something so that she remains with him, satisfied and at peace. As for his ruling for her that the marriage be dissolved, this is a matter of consideration and is referred to the courts.
But my advice to the one afflicted with infertility is to consult the woman and inform her. If she permits it and is satisfied, there is no harm and no blame on him. And if they satisfy her with some money, such as a monthly or annual stipend, there is no harm. But if she insists on requesting a divorce, my advice to him is to divorce her and not to litigate with her in the courts, but rather to divorce her, perhaps Allah will grant her offspring. He may find another wife, and perhaps the doctors were mistaken in saying that he is infertile. Perhaps Allah will make it easy for him to have another wife or a third wife who will bear him children. The doctors may say that he is infertile and be wrong and make a mistake. This is my advice to the brother questioner. Yes.
