You say: I had a child who was forty days old, and he was on the ground in front of me. He had an older brother who was one year old. While he was walking, he fell on his brother. The younger brother survived for a week, and then he passed away. What is required of him, if you would be so kind?
Answer: He owes nothing; because he is not accountable as long as he is a child. He does not owe an expiation, but the blood money is upon the 'aqilah if it is established that he died due to his actions. The 'aqilah are the wealthy male relatives. It is distributed upon them according to their wealth and capacity, and the judge apportions it. It is presented to the court, and the court looks into the matter if the heirs demand it. If the heirs demand the blood money from the 'aqilah, and if they consent, then there is no need for anything.
