The ruling on a wife if it becomes known to the husband that his wife was breastfed by his grandmother

Machine translationRead the Arabic original
This is a message we received from the questioner (M. A. A.) from Iraq, Ninawa Governorate. He says: I married my maternal uncle’s daughter, and she was breastfed by my mother’s mother. In this case, she would be my maternal aunt through breastfeeding, and I have two children from her. I did not know about this matter until I had two children from her. Please advise us, may Allah reward you.
Answer: If it is established that the grandmother breastfed her five known times or more, then she becomes your maternal aunt, the sister of your mother. If it is established that your grandmother, your mother’s mother, breastfed your wife five times or more while she was within the two-year period, and your wife was a young girl within that two-year period, then if this is established by the testimony of trustworthy people, or by the admission of the wet nurse, who is a trustworthy, just person, saying: “I breastfed her five times,” then this wife becomes your maternal aunt, the sister of your mother. Your children from her are legitimate and are attributed to you, because you did not intend the invalidity. So this wife is excused, and you are excused, because you both did not intend what Allah has forbidden, but you both were ignorant of this breastfeeding. So the children are legitimate, and there is no blame on you regarding having intercourse with her in the past, or having intercourse with her in the past, or considering her your wife in the past due to ignorance. And Allah the Exalted says:
And there is no blame upon you for that in which you have erred but [only for] what your hearts intendedوَلَيْسَ عَلَيْكُمْ جُنَاحٌ فِيمَا أَخْطَأْتُمْ بِهِ وَلَكِنْ مَا تَعَمَّدَتْ قُلُوبُكُمْ
[Al-Ahzab: 5], and Allah the Glorious says:
Our Lord, do not impose blame upon us if we have forgotten or erred.رَبَّنَا لا تُؤَاخِذْنَا إِنْ نَسِينَا أَوْ أَخْطَأْنَا
[Al-Baqarah: 286], so Allah said: “I have done it.” So this is an error that is excused, because you did not know. And your children are attributed to you legitimately, because it was intercourse under the doubt of the marriage, and you did not know that she was your maternal aunt. So be at ease, my brother! And let there be no burden in your heart. And divorce her and treat her well, because she is the mother of your two children, so treat her well. And ask your Lord to give you something better than her, and to give her something better than you. And Allah is the One to be asked for help.
The presenter: May Allah reward you.
