Fatwa number ( 16313 )
Q: I (M. A. A.) married my cousin (I. R. A.) thirteen years ago, and we have one daughter who is now twelve years old. A few days ago, I learned that my wife was breastfed by her grandmother, Hidayah, who is her father’s mother, and who is the second wife of my grandfather (Abd al-Hadi), and she is not my father’s mother . I did not know that the milk belongs to the father as it does to the mother. Since we learned this,
we have been separated and are waiting for your answer. As for my wife’s mother and the grandmother who breastfed her, they are alive and well. They testify that my wife was breastfed from the age of a few days until she was one year and a few months old. They do not know that the father has any connection to breastfeeding. They swear by Allah to this. The reason for the breastfeeding was that my wife’s mother was ill, and the father would bring his daughter to his mother, Hidayah, to be breastfed, and she would breastfeed her many times. The reason this matter came to light was hearing a fatwa from His Eminence the Shaykh: Nuh Salman , the mufti of the Hashemite Kingdom of Jordan , via television. The mufti stated or indicated that the owner of the milk is the father, and that if a wife breastfeeds any child, that child becomes the son of the husband through breastfeeding, and a brother to all of the husband’s children, even if they are from other wives. It is known that my grandfather, Abd al-Hadi, is my wife’s paternal grandfather. He married Fatimah, my father’s mother, as his first marriage, and then she passed away. After that, he married Hidayah, my wife’s grandmother, Ikhlās.
A: The condition for breastfeeding that establishes prohibition is that it occurs within the first two years of the child’s life, and that it consists of five breastfeedings or more. The description of a breastfeeding is that the child holds the breast and sucks milk; if he releases it to rest or to move to another breast, it is counted as one breastfeeding, and so on until five breastfeedings are completed. If
it is less, even by one breastfeeding, it does not establish prohibition. This is based on His saying, the Exalted, regarding those who are prohibited:[An-Nisa 4:23] , and His saying, peace and blessings be upon him, in the hadith agreed upon by al-Bukhari and Muslim: Sunan Ibn Majah 1937Sahih (Darussalam) . And Muslim narrated from Aisha (may Allah be pleased with her) that she said: And from her also, she said: The Messenger of Allah, peace and blessings be upon him, said: Sunan Abi Dawud 2063Sahih (Al-Albani) Narrated by Muslim . Therefore, if it is established that your wife was breastfed by the wife of your paternal grandfather, she becomes your aunt, and you must separate from her. This is based on the saying of the Messenger of Allah, peace and blessings be upon him: Sunan Ibn Majah 1937Sahih (Darussalam) Even if the woman who breastfed her was not your grandmother but another wife of your grandfather, the ruling is the same. If there is a dispute in this matter, the reference is to the Shari'ah court. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
