Q: About twenty-five years ago, roughly, I had intercourse with my husband during Ramadan, and the call to Fajr prayer was about to end. My husband is a mature, grown man; I do not know if he knew the ruling at that time or not. As for me, I was ignorant of the ruling and did not know that it was not permissible, as I was about twenty years old. I recently learned, when knowledge became available and I heard fatwas on the radio, that this is not permissible. I hope you will issue a ruling on this matter, for I am remorseful for that act. May Allah reward you with good.
A: If the mu'adhdhin was calling the adhan at the appearance of Fajr, then this intercourse is considered to have taken place during the day of Ramadan. Therefore, each of the aforementioned spouses must make up that day, and each of them must pay the expiation, which is freeing a believing slave. If he does not find one, he must fast two consecutive months. If he is unable to do so, he must feed sixty poor people. Additionally, each of them must feed one poor person for delaying the making up of the day on which the intercourse occurred.
