A377: The scholars, may Allah have mercy on them, differed regarding the recitation of al-Fatihah by the follower. Some held that it is obligatory and that it is not permissible to leave it, and that the follower must recite it behind the imam in all cases. Others held that the imam’s recitation suffices for the follower, but that it is recommended for the follower to recite it during the imam’s pauses and in the silent prayers. Others made it obligatory for the follower to recite al-Fatihah in the silent prayers but not in the loud prayers, based on the generality of the statement of Allah the Exalted:
So when the Qur'an is recited, then listen to it and pay attention that you may receive mercy.وَإِذَا قُرِئَ الْقُرْآنُ فَاسْتَمِعُوا لَهُ وَأَنْصِتُوا لَعَلَّكُمْ تُرْحَمُونَ
[Al-A'raf 7:204]
. In my view, this is the most correct of the opinions, because it reconciles the evidence. The recitation that is obligatory is attributed to the follower’s recitation in the silent prayers, and the hadiths that drop the recitation for the follower are attributed to the loud prayers, based on the statement of Allah the Exalted:
