Q319: The questioner, A. A. from Al-Khums High School in Libya, asks: What is the ruling on one who missed the five daily prayers due to sleep or other reasons? Should he delay them until the time of that prayer arrives the next day, or should he make them up immediately once the excuse is removed?
A319: It is obligatory to make them up immediately once the excuse is removed; based on the saying of the Prophet (peace and blessings be upon him):
Whoever forgets a prayer or sleeps through it, let him pray it when he remembers it. There is no expiation for it other than that.من نسي صلاة أو نام عنها فليصلها إذا ذكرها، لا كفارة لها إلا ذلك
Sunan ad-Darimi 2:45
Therefore, it is obligatory for him to hasten to make them up as soon as the excuse is removed from him, and it is not permissible for him to delay them until the next day; because their time is when the excuse is removed.
