Q: In the last few months, a fatwa has circulated in Jeddah and its surrounding villages, and we have received many questions about it. It states that it is not permissible for anyone to perform 'Umrah as a voluntary act during the months of Hajj , and that whoever does so must perform Hajj in the year in which he performed 'Umrah. On 8/11/1416 AH, His Eminence Shaykh Muhammad ibn Salih al-Uthaymeen delivered a lecture in Jeddah , and this fatwa was presented to him because of the large number of papers received during the lecture inquiring about this fatwa. He answered
His Eminence by declaring this fatwa invalid, and asked me to write to Your Eminence regarding it so that the response would be in writing and circulated so that its benefit would be widespread. What is Your Eminence’s opinion?

A : 'Umrah is permissible in all months of the year; because the timing was only specified for Hajj by the saying of Allah, the Exalted and Most High:
Hajj is [during] well-known monthsالْحَجُّ أَشْهُرٌ مَعْلُومَاتٌ
[Al-Baqarah 2:197]
, and whoever performs 'Umrah in the months of Hajj is not required to perform Hajj in that year in which he performed 'Umrah; because there is no evidence obligating him to do so. The Prophet (peace and blessings be upon him) performed 'Umrah in the eighth year of the Hijrah after the Battle of Hunayn from al-Ji'ranah in Shawwal, and he did not perform Hajj in that year. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
