Q: It happens that I go, as a volunteer, with my colleagues to transport prisoners from the city of Bisha to the city of Jeddah , in order to deport them to their countries, and among
these deported workers are non-Muslims, including Christians, Hindus, and others. And when we approach Makkah , there are two roads: one for Muslims and one for non-Muslims. Because the road for non-Muslims is far and difficult for us, we take the road for Muslims and pass by the sacred sites, such as Mina and Muzdalifah . We do not stop, we only pass through, in order to shorten the journey. Is this permissible for us, or is it not permissible? I have asked my colleagues, and they say that they consulted a judge in the province of Bisha , and he said that it is permissible. So please advise us, may Allah reward you

A : As long as there are non-Muslim workers with you during your journey, such as Christians, Hindus, and other polytheists, to be deported to their countries, it is obligatory for you, in this situation, to take the road designated for non-Muslims, even if it is more difficult. It is not permissible for you to take the road designated for Muslims; because that necessitates bringing them inside the boundaries of the Haram , and that is forbidden; due to the saying of Allah the Exalted:
O you who have believed, indeed the polytheists are unclean, so let them not approach al-Masjid al-Haram after this, their [final] yearيَا أَيُّهَا الَّذِينَ آمَنُوا إِنَّمَا الْمُشْرِكُونَ نَجَسٌ فَلا يَقْرَبُوا الْمَسْجِدَ الْحَرَامَ بَعْدَ عَامِهِمْ هَذَا
[At-Tawbah 9:28]
the verse.
